第一章总则
第一条为规范学生校内申诉制度，全面推进依法治校工作，保证学校对学生的处理行为的客观、公正、公平，保护学生的合法权益，维护学校良好的教学管理秩序，依据《普通高等学校学生管理规定》和相关法律法规，制定本办法。
第二条我校取得学籍的本科生、研究生，对学校依据法律、法规和学校规定，对本人给予的处分或处理决定有异议的，可以向beplay体育软件正规 学生申诉处理委员会（以下简称学生申诉处理委员会）提出申诉，学生申诉处理委员会受理申诉、做出申诉复查决定，适用本办法。
第三条学生申诉时，应当依据事实、相关规定提出申诉。
第四条学生申诉处理委员会处理学生申诉时，应当做到程序合法、依据明确、定性准确、处理恰当。
第二章学生申诉处理委员会
第五条学生申诉处理委员会是学校处理学生申诉的专门机构。该委员会由9人组成，主任由学校分管学生工作的校领导担任，委员包括党办校办负责人、纪委办公室负责人、党委学生工作部（处）负责人、团委负责人、教务处负责人、教师代表、学生代表、法律顾问。教师代表的产生原则上由人事处人事科负责；学生代表的产生原则上由校团委学生会负责。学生申诉处理委员会下设办公室，办公室设在党办校办法律事务室，党办校办安排专人担任学生申诉处理委员会秘书。
第六条学生申诉处理委员会履行下列职责：
（一）受理学生对取消入学资格、退学处理或者违规违纪处分的申诉；
（二）向有关单位和人员调查取证，查阅文件和资料；
（三）对申诉进行复查处理，并做出申诉复查决定；
（四）协助申诉人办理因不服申诉复查决定而向四川省教育厅提出申诉的有关事项；
（五）学校规定的其他职责。
第七条学生申诉处理委员会履行申诉复查职责，遵循合法、公正、公开、回避的原则，坚持有错必纠、及时处理、便利学生的工作作风，同时应保障法律、法规和学校规定的正确实施。
第三章申诉受理
第八条学生对学校做出的涉及本人权益的下列处理或处分决定有异议的，可以在接到学校处理或者处分决定书之日起10日内，向学校学生申诉处理委员会提出书面申诉：
（一）被取消入学资格的；
（二）被退学处理的；
（三）因违法违纪、违规而受到警告、严重警告、记过、留校察看、开除学籍等纪律处分的；
（四）法律法规规定可以提出申诉的其他处理决定。
第九条因不可抗力或者其他正当理由耽误法定申诉期限的，应在障碍因素消失后，说明理由并提供相关证明材料，经学生申诉处理委员会核查属实的，可视为申诉时限内提出，但做出复查结论的时间，应以收到书面申诉书之日算起。
提出申诉时，申诉人或代理人应当向学生申诉处理委员会递交《beplay体育软件正规 学生申诉书》，并按学校要求准确填写且附上学校做出的原处理（或处分）决定书（复印件）。《beplay体育软件正规 学生申诉书》应当载明下列事项：
（一）申诉人姓名、性别、籍贯、身份证号、学号、所在学院、专业、年级、班级以及其他基本情况；
（二）申诉事项、理由和要求；
（三）申诉人本人的联系电话、通讯地址;
（四）申诉人本人亲笔签名；
（五）提出申诉的日期。
若有权申诉的申诉人为无民事行为能力人或者限制民事行为能力人的，其近亲属或代理人可以代为申诉。
第十条自处理、处分送达之日起，学生在申诉期限内未提出申诉的视为放弃申诉，学校不再受理其提出的申诉。
处理、处分未告知学生申诉期限的，申诉期限自学生知道或者应当知道处理或者处分决定之日起计算，但最长不得超过6个月。
第十一条在申诉期间，取消入学资格、退学、开除学籍的处理或处分决定暂停执行，其他处理或处分决定不停止执行。
第四章申诉的复查与复查决定
第十二条学生申诉处理委员会应当对予以受理的申诉进行复查，并在接到书面申诉之日起15日内，作出复查结论并告知申诉人。情况复杂不能在规定限期内作出结论的，经学生申诉处理委员会主任批准，可延长15日。复查结论以申诉复查决定书的形式告知申诉人。
第十三条对申诉的复查，学生申诉处理委员会可根据实际情况分别采取一般程序或听证程序进行。
第十四条决定采取一般程序复查的，由学生申诉处理委员会组织成立申诉复查小组，具体负责该项申诉的复查。
第十五条申诉复查小组按以下程序对申诉人的申诉进行复查：
（一）提取原处理的原始材料，对原处理予以复查；
（二）听取申诉人的申辩，向申诉人进行书面询问；
（三）听取原处理部门领导、经办人及其他相关人员的意见；
（四）对申诉人提出的新线索、新情况予以核实或查证；
（五）申诉复查小组综合以上情况，向学生申诉处理委员会提交该项申诉的复查报告。
第十六条采取一般程序复查后，学生申诉处理委员会应召开学生申诉复查专题会议，以复查小组的复查报告为基础，对申诉人提出的申诉进行复查讨论，并做出复查结论。
第十七条申诉人在申诉申请书中提出要求采用听证程序并经学生申诉处理委员会依程序批准，学生申诉的复查可以采用听证程序进行，但听证只适用于：
（一）申诉人对受到学校取消入学资格和退学处理的申诉；
（二）申诉人对受到学校给予开除学籍处分的申诉。
第十八条学生申诉处理委员会在接到要求采取听证程序的申诉申请后，由主任在3个工作日内作出是否采取听证程序的决定。决定采取听证程序复查的，应当指定听证会主持人，并授权职能部门组织进行。
第十九条听证会的参加人员应当包括申请人、证人、违纪行为调查人员、评议员以及主持人等。
听证评议员由学生申诉处理委员会委员担任，一般不少于学生申诉处理委员会委员的2/3，其中应当包括教师代表和学生代表。对学生违纪情况进行调查的人员不能担任听证评议员。
第二十条除涉及当事人隐私或当事人申请不公开外，听证应当公开举行，允许师生旁听。
组织听证的职能部门应当在做出听证决定之日起3个工作日内确定听证的时间、地点、评议员等，并于举行听证的3个工作日前通知各参加人员。如听证公开举行，应当同时发布公告。
申请旁听的师生，应当在听证举行前2个工作日内向组织听证的职能部门提出申请。
第二十一条违纪学生应当参加听证，因特殊情况不能参加的，可以委托1－2人代理。违纪学生本人或其代理人未按期参加听证并且事先未说明理由的，视为放弃听证权利，申诉复查程序终止。
第二十二条听证会由主持人在听证评议员中指定一人作为记录员。听证会开始前，记录员应当查明听证参加人是否到场并宣布听证纪律。听证活动全过程应当制作听证笔录，并经过申请人和听证评议员签字确认后归档。
听证会按下列程序进行：
（一）调查人员陈述学生违纪的事实、证据及处分依据；
（二）申请人或委托代理人进行陈述和申辩，并提供相关证据和证人；
（三）听证评议员对调查人员和申请人或委托代理人、证人等进行询问并进行质证；
（四）调查人员和申请人辩论。
（五）听证评议员应当就听证的情况做出评议，形成听证复查意见书。
第二十三条采取听证程序复查后，学生申诉处理委员会应召开学生申诉复查专题会议，以听证复查意见书为基础对申诉人提出的申诉进行复查讨论，并做出复查结论。
第二十四条学生申诉处理委员会召开的学生申诉复查专题会议，应当有2/3以上的学生申诉处理委员会成员到会，且由1/2以上（不含本数）的到会人员通过的申诉复查结论才能视为有效。
第二十五条依据复查结论，学生申诉处理委员会要区别不同情况，做出下列决定并制作相应申诉复查决定书：
（一）通过复查认为原处理事实清楚，证据确凿，适用依据正确，程序合法，定性准确，过罚相当的，应当做出维持原处理决定的决定。
（二）通过复查认为原处理决定有下列情况之一的，学生申诉处理委员会可以做出建议撤销或变更的复查意见，要求相关职能部门予以研究，重新提交校长办公会或者专门会议作出决定：
事实认定不清楚，证据不足的；
适用依据错误的；
过罚不相当的；
处理程序不当的。
第二十六条学生申诉处理委员会应当在规定期限内将复查决定书直接送达学生本人；学生拒绝签收的，以留置方式送达，但须邀请教师代表1人、学生代表2人到场见证，并由送达人、见证人在处分送达书上签名；已离校的，采取邮寄方式送达；难于联系的，通过学校网站以公告方式送达，公告期为7日，期满视为送达。
第二十七条学生对复查决定有异议的，在接到学校复查决定书之日起15日内，可以向学校所在地省级教育行政部门提出书面申诉。
第二十八条在学生申诉处理委员会未做出申诉处理决定前，申诉人可以撤回申诉。要求撤回申诉的，必须以书面形式提出。撤回申诉后，申诉人不得以同一事实和理由再次申诉。
第五章附则
第二十九条接受高等学历继续教育的学生、港澳台侨学生、留学生的申诉处理，参照本办法执行。
第三十条本办法于2017年7月20日经beplay体育软件正规2017年第5次校长办公会议讨论通过，自2017年9月1日起施行。

第一章总则
Chapter I General Provisions
第一条为规范学生校内申诉制度，全面推进依法治校工作，保证学校对学生的处理行为的客观、公正、公平，保护学生的合法权益，维护学校良好的教学管理秩序，依据《普通高等学校学生管理规定》和相关法律法规，制定本办法。
Article 1Management Measures for Student Appeal Settlement of Southwest Petroleum University（hereinafter referred to as the Measures）is hereby formulated in accordance with Common University Student Management Rules and relevant laws and regulations to standardize the student appeal system of the university, comprehensively promote the law-based university governance, ensure that the university treats students objectively, impartially and fairly, protect the legitimate rights and interests of students and maintain the sound teaching management order of the university.
第二条我校取得学籍的本科生、研究生，对学校依据法律、法规和学校规定，对本人给予的处分或处理决定有异议的，可以向beplay体育软件正规 学生申诉处理委员会（以下简称学生申诉处理委员会）提出申诉，学生申诉处理委员会受理申诉、做出申诉复查决定，适用本办法。
Article 2Undergraduates and postgraduates in our university with the student status who have objections to any decision of punishment or treatment given to them by the university in accordance with the laws, regulations and the university regulations may lodge a complaint with the Student Appeal Committee of Southwest Petroleum University（hereinafter referred to as the Student Appeal Committee）which will accept the appeal and make an appeal review decision, to which the Measures is applicable.
第三条学生申诉时，应当依据事实、相关规定提出申诉。

第二章学生申诉处理委员会
Chapter II Student Appeal Committee
第五条学生申诉处理委员会是学校处理学生申诉的专门机构。该委员会由9人组成，主任由学校分管学生工作的校领导担任，委员包括党办校办负责人、纪委办公室负责人、学生工作部（处）负责人、团委负责人、教务处负责人、教师代表、学生代表、法律顾问。教师代表的产生原则上由人事处人事科负责；学生代表的产生原则上由校团委学生会负责。学生申诉处理委员会下设办公室，办公室设在党办校办法律事务室，党办校办安排专人担任学生申诉处理委员会秘书。
Article 5The Student Appeal Committee is a special body of the university to deal with student appeals. The committee is made up of 9 people, and the director shall be the university director in charge of student work and the committee members shall include the director of the Office of the Party Committee and the Office of the Principal, the director of the Office of Discipline Supervision and Checkup, the director of the Student Work Department , the head of the CCYL Committee, the head of the Office of Academic Affairs, a teachers' representative, a students' representative, and a legal adviser. In principle, the Personnel Office of the Human Resources Department shall be responsible for the generation of the teachers' representative and the Student Union of the Youth League Committee of the university shall be responsible for the generation of the students' representative. 第六条学生申诉处理委员会履行下列职责：
Article 6The Student Appeal Committee shall:
（一）受理学生对取消入学资格、退学处理或者违规违纪处分的申诉；
（i）accept students' appeals on disqualification of admission, dropping out, or punishment of discipline violations;
（二）向有关单位和人员调查取证，查阅文件和资料；
（ii）investigate and collect evidence from the relevant organizations and personnel as well as consult documents and data;
（三）对申诉进行复查处理，并做出申诉复查决定；
（iii）review an appeal and make the appeal review decision;
（四）协助申诉人办理因不服申诉复查决定而向四川省教育厅提出申诉的有关事项；
（iv）assist the complainant in handling relevant matters of lodging an appeal to the Education Department of Sichuan Province due to his/her dissatisfaction with the appeal review decision.
（五）学校规定的其他职责。
（v）be responsible for other duties prescribed by the university.
第七条学生申诉处理委员会履行申诉复查职责，遵循合法、公正、公开、回避的原则，坚持有错必纠、及时处理、便利学生的工作作风，同时应保障法律、法规和学校规定的正确实施。
Article 7The Student Appeal Committee shall perform the duty of appeal review and follow the principle of legality, justice, openness and avoidance, adhere to the work style of correcting mistakes, timely handling and facilitating students' work and also ensure the correct implementation of laws, regulations and the university regulations.
第三章申诉受理
Chapter III Appeal Acceptance
第八条学生对学校做出的涉及本人权益的下列处理或处分决定有异议的，可以在接到学校处理或者处分决定书之日起10日内，向学校学生申诉处理委员会提出书面申诉：
Article 8Students who have objections to the following disposal or punishment decisions made by the university concerning their own rights and interests may lodge a written complaint with the Student Appeal Committee of the university within 10 days after receiving a disposal or punishment decision letter:
（一）被取消入学资格的；
（i）Disqualification of admission;
（二）被退学处理的；
（ii）Dropping out;
（三）因违法违纪、违规而受到警告、严重警告、记过、留校察看、开除学籍等纪律处分的；
（iii）Disciplinary sanctions such as warning, serious warning, demerit recording, academic probation, and expulsion from the university due to the violation of laws, disciplines and regulations;
（四）法律法规规定可以提出申诉的其他处理决定。
（iv）Other handling decisions which may be complained about as regulated by laws and regulations.
第九条因不可抗力或者其他正当理由耽误法定申诉期限的，应在障碍因素消失后，说明理由并提供相关证明材料，经学生申诉处理委员会核查属实的，可视为申诉时限内提出，但做出复查结论的时间，应以收到书面申诉书之日算起。
Article 9If the legal time limit for appeal is delayed due to force majeure or other legitimate reasons, the reasons shall be explained and relevant supporting materials shall be provided after the obstacle factors have disappeared, and any appeal shall be deemed to be filed within the time limit for appeal if being verified by the Student Appeal Committee while the time for making the review conclusion shall be counted from the date of receipt of the written complaint.

When lodging an appeal, the complainant or agent shall submit aStudent Appeal of Southwest Petroleum Universityto the Student Appeal Committee and fill out correctly and attach the original disposal（or punishment）decision（copy）as required by the university. TheStudent Appeal of Southwest Petroleum Universityshall contain the following items:
（一）申诉人姓名、性别、籍贯、身份证号、学号、所在学院、专业、年级、班级以及其他基本情况；
（i）Name, gender, native place, ID card No., student No., college, major, grade, class and other basic information of the complainant;
（二）申诉事项、理由和要求；
（ii）Appeal matters, reasons and requirements;
（三）申诉人本人的联系电话、通讯地址;
（iii）The complainant's own telephone number and address;
（四）申诉人本人亲笔签名；
（iv）The complainant's own signature;
（五）提出申诉的日期。
（v）Date of appeal.
若有权申诉的申诉人为无民事行为能力人或者限制民事行为能力人的，其近亲属或代理人可以代为申诉。
If a complainant with the right to appeal has no capacity for civil conduct or has limited capacity for civil conduct, a close relative or agent may lodge an appeal on his behalf.
第十条自处理、处分送达之日起，学生在申诉期限内未提出申诉的视为放弃申诉，学校不再受理其提出的申诉。
Article 10If a student fails to appeal within the time limit for appeal upon the date of the service of disposal and punishment, he/she shall be deemed to give up the appeal, and the university shall not accept any appeal lodged by him/her.
处理、处分未告知学生申诉期限的，申诉期限自学生知道或者应当知道处理或者处分决定之日起计算，但最长不得超过6个月。

第十一条在申诉期间，取消入学资格、退学、开除学籍的处理或处分决定暂停执行，其他处理或处分决定不停止执行。
Article 11During the appeal period, disposal or punishment decisions including disqualification of admission, dropping out or expulsion from the university shall be suspended, while other disposal or punishment decisions shall not be suspended.
第四章申诉的复查与复查决定
Chapter IV Appeal Review and Review Decision
第十二条学生申诉处理委员会应当对予以受理的申诉进行复查，并在接到书面申诉之日起15日内，作出复查结论并告知申诉人。情况复杂不能在规定限期内作出结论的，经学生申诉处理委员会主任批准，可延长15日。复查结论以申诉复查决定书的形式告知申诉人。
Article 12The Student Appeal Committee shall review the appeal that has been accepted and, within 15 days from the date of receipt of the written appeal, make a conclusion of the review and inform the complainant. If the circumstances are too complex to reach a conclusion within the prescribed time limit, the period may be extended for 15 days upon the approval of the director of the Student Appeal Committee. The review conclusion shall be communicated to the complainant in the form of an appeal review decision.
第十三条对申诉的复查，学生申诉处理委员会可根据实际情况分别采取一般程序或听证程序进行。
Article 13For the appeal review, the Student Appeal Committee may adopt general procedure or hearing procedure respectively according to the actual situation.
第十四条 决定采取一般程序复查的，由学生申诉处理委员会组织成立申诉复查小组，具体负责该项申诉的复查。
Article 14If it is decided to adopt the general procedure to review, the Student Appeal Committee shall organize and set up an appeal review team to be specifically responsible for the review of the appeal.
第十五条申诉复查小组按以下程序对申诉人的申诉进行复查：
Article 15The appeal review team shall review the appeal of the complainant in accordance with the following procedures:
（一）提取原处理的原始材料，对原处理予以复查；
（i）Extract the raw materials for the original treatment and review the original treatment;
（二）听取申诉人的申辩，向申诉人进行书面询问；
（ii）Hear the complainant's defense and make written inquiries to the complainant;
（三）听取原处理部门领导、经办人及其他相关人员的意见；
（iii）Listen to the opinions of the leader, manager and other relevant personnel of the original handling department;
（四）对申诉人提出的新线索、新情况予以核实或查证；
（iv）Check or verify new clues and new situations put forward by the complainant;
（五）申诉复查小组综合以上情况，向学生申诉处理委员会提交该项申诉的复查报告。
（v）Based on the above-mentioned situations, the appeal review team shall submit the review report of the appeal to the Student Appeal Committee.
第十六条采取一般程序复查后，学生申诉处理委员会应召开学生申诉复查专题会议，以复查小组的复查报告为基础，对申诉人提出的申诉进行复查讨论，并做出复查结论。
Article 16After the general procedure is adopted to review, the Student Appeal Committee shall convene a special meeting on student appeal review, and based on the review report of the review team, carry out review discussion for the appeal lodged by the complainant and make a review conclusion.
第十七条申诉人在申诉申请书中提出要求采用听证程序并经学生申诉处理委员会依程序批准，学生申诉的复查可以采用听证程序进行，但听证只适用于：
Article 17If the complainant makes a request in the appeal application for a hearing procedure and has been approved by the Student Appeal Committee, the review of student appeal may be conducted through a hearing procedure, but the hearing procedure shall only apply to:
（一）申诉人对受到学校取消入学资格和退学处理的申诉；
(i)an appeal of the complainant against the disqualification of admission and being dropped out;
（二）申诉人对受到学校给予开除学籍处分的申诉。
（ii）an appeal of the complainant against being expelled from the university.
第十八条学生申诉处理委员会在接到要求采取听证程序的申诉申请后，由主任在3个工作日内作出是否采取听证程序的决定。决定采取听证程序复查的，应当指定听证会主持人，并授权职能部门组织进行。
Article 18After receiving an appeal application for the hearing procedure, the director of the Student Appeal Committee shall decide whether to adopt the hearing procedure within 3 working days. If a decision is made to adopt the hearing procedure to review, the presiding officer of the hearing shall be appointed and the functional departments shall be authorized to organize the review.
第十九条听证会的参加人员应当包括申请人、证人、违纪行为调查人员、评议员以及主持人等。
Article 19Participants in the hearing shall include applicants, witnesses, investigators of disciplinary conduct, judges and presiding officers, etc.
听证评议员由学生申诉处理委员会委员担任，一般不少于学生申诉处理委员会委员的2/3，其中应当包括教师代表和学生代表。对学生违纪情况进行调查的人员不能担任听证评议员。
The hearing judges shall be members of the Student Appeal Committee, generally no less than two-thirds of the members of the Student Appeal Committee, which shall include the teachers' representative and the students' representative. Personnel investigating students' disciplinary violations shall not serve as the hearing judges.
第二十条除涉及当事人隐私或当事人申请不公开外，听证应当公开举行，允许师生旁听。
Article 20Apart from those involving the privacy of the parties concerned or required by the parties concerned to be closed, hearings shall be held in public and teachers and students shall be allowed to attend the hearings.
组织听证的职能部门应当在做出听证决定之日起3个工作日内确定听证的时间、地点、评议员等，并于举行听证的3个工作日前通知各参加人员。如听证公开举行，应当同时发布公告。

申请旁听的师生，应当在听证举行前2个工作日内向组织听证的职能部门提出申请。

第二十一条违纪学生应当参加听证，因特殊情况不能参加的，可以委托1－2人代理。违纪学生本人或其代理人未按期参加听证并且事先未说明理由的，视为放弃听证权利，申诉复查程序终止。
Article 21Students who violate discipline shall participate in the hearing. If they cannot participate in the hearing due to special circumstances, they may entrust one or two persons to represent them. If a student who violates discipline or his or her agent fails to attend the hearing as scheduled and fails to explain the reasons in advance, the student or his/her agent shall be deemed to have waived the hearing right and the appeal review procedure shall be terminated.
第二十二条听证会由主持人在听证评议员中指定一人作为记录员。听证会开始前，记录员应当查明听证参加人是否到场并宣布听证纪律。听证活动全过程应当制作听证笔录，并经过申请人和听证评议员签字确认后归档。
Article 22The presiding officer shall designate one of the hearing judges as the recorder. Before a hearing begins, the recorder shall ascertain whether the participants of the hearing are present and declare the hearing discipline. A written record of the hearing shall be prepared and filed after being signed and confirmed by the applicant and the hearing judges.
听证会按下列程序进行：
A hearing shall be conducted in the following procedures:
（一）调查人员陈述学生违纪的事实、证据及处分依据；
（i）The investigator states the facts, evidence and punishment basis of the students' violations of discipline;
（二）申请人或委托代理人进行陈述和申辩，并提供相关证据和证人；
（ii）The applicant or the entrusted agents makes a statement and defends, and provides relevant evidence and witnesses;
（三）听证评议员对调查人员和申请人或委托代理人、证人等进行询问并进行质证；
（iii）The hearing judges inquire and cross-examine the investigator and the applicant or the entrusted agents and witnesses;
（四）调查人员和申请人辩论。
（iv）The investigator and the applicant debate.
（五）听证评议员应当就听证的情况做出评议，形成听证复查意见书。
（v）The hearing judges make comments on the circumstances of the hearing and form hearing review opinions.
第二十三条采取听证程序复查后，学生申诉处理委员会应召开学生申诉复查专题会议，以听证复查意见书为基础对申诉人提出的申诉进行复查讨论，并做出复查结论。
Article 23After the hearing procedure is adopted to review, the Student Appeal Committee shall convene a special meeting on student appeal review, and based on the hearing review opinions, carry out review discussion for the appeal lodged by the complainant and make a review conclusion.
第二十四条学生申诉处理委员会召开的学生申诉复查专题会议，应当有2/3以上的学生申诉处理委员会成员到会，且由1/2以上（不含本数）的到会人员通过的申诉复查结论才能视为有效。
Article 24The special meeting on student appeal review held by the Student Appeal Committee shall be attended by more than two-thirds of the members of the Student Appeal Committee and the appeal review conclusion shall be deemed valid only after being accepted by more than half（excluding the half）of the participants.
第二十五条依据复查结论，学生申诉处理委员会要区别不同情况，做出下列决定并制作相应申诉复查决定书：
Article 25According to the review conclusion, the Student Appeal Committee shall make the following decisions and prepare the corresponding appeal review decision according to different situations:
（一）通过复查认为原处理事实清楚，证据确凿，适用依据正确，程序合法，定性准确，过罚相当的，应当做出维持原处理决定的决定。
（i）If the original treatment is considered to have clear facts, conclusive evidence, correct application basis, legal procedures, qualitative accuracy and appropriate punishment after the review, a decision shall be made to maintain the original treatment decision.
（二）通过复查认为原处理决定有下列情况之一的，学生申诉处理委员会可以做出建议撤销或变更的复查意见，要求相关职能部门予以研究，重新提交校长办公会或者专门会议作出决定：
（ii）If the original treatment decision is considered to have one of the following circumstances after the review, the Student Appeal Committee may make a review opinion of withdraw or change recommendation and request relevant functional departments to conduct research and resubmit to the Principal's Office Meeting or the special meeting to make a decision:
1.事实认定不清楚，证据不足的；
Unclear facts and insufficient evidence;
2.适用依据错误的；
Wrong application basis;
3.过罚不相当的；
Inappropriate punishment;
4.处理程序不当的。
Incorrect handling procedures.
第二十六条学生申诉处理委员会应当在规定期限内将复查决定书直接送达学生本人；学生拒绝签收的，以留置方式送达，但须邀请教师代表1人、学生代表2人到场见证，并由送达人、见证人在处分送达书上签名；已离校的，采取邮寄方式送达；难于联系的，通过学校网站以公告方式送达，公告期为7日，期满视为送达。
